Terms of Service

These Terms of Service ("Terms") govern your use of SalesPage Studio by Creations by Maggie (the "Service"), operated by Creations by Maggie ("we", "us"). By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Acceptable Use Policy.

1. The Service

The Service helps you write, design and publish sales pages, mockups, audits and launch materials using templates and artificial intelligence (AI).

2. No guarantee of sales or results

We do not guarantee any sales, revenue, conversions, leads, rankings or other results. Examples, scores, audits and suggestions are educational and are not a promise of outcomes. Your results depend on your offer, audience, effort and many factors outside our control.

3. AI-generated content

Content produced with AI may be inaccurate, incomplete, out of date or similar to content created for others. You must review, edit and verify all content before you publish or use it. You are responsible for any content you choose to publish.

4. Your responsibilities

You are solely responsible for your pages, products, services, offers, prices, claims, testimonials, images and everything you publish through the Service, and for complying with all laws that apply to you. This includes consumer protection, advertising, privacy and FTC rules on endorsements, testimonials and earnings or income claims. Only use testimonials and results that are real and that you have permission to use.

5. Accounts

You must provide accurate information and keep your login details secure. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.

6. Plans, payments and no refunds

• Paid plans are billed in advance on a recurring basis (monthly or yearly) until cancelled.
• The Single Page Pass is a one-time payment, not a subscription. It unlocks Pro features for one page in your account for as long as your account exists. It does not add more pages and does not include Boost packs. If you later subscribe to Pro, no credit or refund is given for the pass.
• All sales, subscriptions, renewals, Single Page Passes, Boost packs and top-ups are final and non-refundable, including for partial periods and unused allowances, except where a refund is required by law.
• You can cancel anytime. Cancellation takes effect at the end of your current billing period, and you keep access until then.
• If a payment fails, paid features may be paused until payment succeeds. On downgrade, only the pages allowed by your new plan stay editable and published; the rest are kept.
• We may change prices with notice. Changes apply from your next billing period.

7. Founding Member price

The Founding Member price is offered to a limited number of early subscribers on the monthly plan. It stays the same for as long as your subscription remains continuously active on the same plan. If you cancel, switch plans, or your subscription lapses, the Founding price ends and cannot be restored.

8. Fair use, Boost packs and auto top-up

• Pro plans include monthly fair-use allowances for AI features (such as page generations, section rewrites, audits and launch kits). A Single Page Pass includes the same monthly allowances for AI on its one page (Launch Kits are not included). Allowances reset each billing month and unused monthly allowances do not roll over.
• Boost packs are optional one-time purchases that add extra AI usage. Boost credits are used after your monthly allowance and expire 12 months after purchase.
• Auto top-up is optional and off by default. If you turn it on, we will automatically charge the price shown for a Boost pack when you run out, up to the monthly spending cap you choose, and email you a receipt each time. You can turn it off anytime.
• We may limit, pause or block automated, excessive or abusive use to protect the Service. Viewing, editing, exporting and publishing existing pages is not affected by fair-use limits.

9. Your content and our license

You keep ownership of the content you upload or create ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and transmit Your Content, including sending it to AI providers, only as needed to operate, improve and provide the Service to you. This license ends when you delete Your Content or your account, except for backups kept for a limited time and records we must keep by law.

10. Our content

The Service, its software, templates, designs, mockup artwork and branding belong to Creations by Maggie. You may use templates and generated mockups for your own business pages and marketing. You may not resell, copy or redistribute the Service or its templates as your own product.

11. Suspension and termination

We may suspend or terminate your account, unpublish pages, or remove content at any time if we reasonably believe you have violated these Terms or the Acceptable Use Policy, created risk or legal exposure for us or others, or if required by law. You may stop using the Service and delete your account at any time from your settings.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free. Nothing in the Service is legal, financial or tax advice.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify and hold harmless Creations by Maggie and its owners, contractors and partners from any claims, damages, losses and expenses (including reasonable legal fees) arising from Your Content, your pages, products, claims or testimonials, your use of the Service, or your violation of these Terms or any law.

15. Changes to these Terms

We may update these Terms. We will post the new version with a new date and, for material changes, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.

16. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Texas, unless the law requires otherwise.
